THE TEXAS FORECLOSURE PROCESS:

1. Notice of Default / Demand Letter - By law, the lender has to send a written notice allowing you at least 20 days to bring the defaulted loan current.

2. Notice of Sale  - The law requires at least 21 days written notice from the date the house is to be sold at auction. The 21 days begin from the date the notice is mailed, not the date you receive it.

3. Foreclosure Sale - Foreclosure sales are held at the county courthouse on the first Tuesday of each month also known as "Texas Tuesday". Once your home has made it to the courthouse steps it will be sold then and there to the highest cash bidder. After the auction, you do not have the right to buy back your property from the new owner unless it is being sold by a government entity or a tax lender. There are time limits involved and in some cases you must pay a redemption fee.
